Terms & Conditions

Last updated: July 2026

1. About These Terms

These terms and conditions govern the relationship between LeCodeur ("we", "us", "the agency"), a web design and development agency based in Randburg, Johannesburg, South Africa, and any client ("you", "the client") who engages us to design, build, host, or maintain a website, online store, or web application.

By instructing us to begin work, whether through a signed quote, an email confirmation, or a WhatsApp message accepting a proposal, you agree to be bound by these terms.

2. Quotes & Pricing

All quotes are provided in South African Rand (ZAR) and are valid for 30 days from the date issued, unless stated otherwise.

We offer two pricing models: a Monthly Plan, which includes hosting, updates and support for the duration of the subscription, and a Once-off Fee, which is a single payment covering the design and build of the site, with hosting available separately on a yearly basis.

Prices displayed on our website are indicative starting prices. A final, fixed quote is provided after the discovery call, based on the specific scope of your project.

3. Payment Terms

Monthly Plan clients are billed in advance each month. Non-payment for a period exceeding 30 days may result in the site being taken offline until the account is settled.

Once-off Fee clients are typically required to pay a 50% deposit before work begins, with the remaining balance due before the completed site is launched or handed over.

Yearly hosting fees for once-off clients are billed annually in advance and are non-refundable once the hosting period has started.

4. Project Scope & Revisions

Each service tier includes a defined number of revision rounds, as set out on our Pricing and Services pages. Additional revisions beyond what is included may be quoted and billed separately.

Changes to the agreed scope of a project, such as adding new pages, features, or functionality after work has begun, may affect the project timeline and cost. We will always communicate this before proceeding.

5. Content & Client Responsibilities

You are responsible for providing accurate, lawful, and timely content, including text, images, logos, and product information, required to complete your project.

Delays in providing requested content may result in corresponding delays to your project timeline.

You confirm that you have the legal right to use any content, images, trademarks, or logos you provide to us for use on your site.

6. Ownership & Intellectual Property

Once a project is paid in full, ownership of the final website design and code transfers to the client, with the exception of any third-party assets, plugins, or licensed stock photography, which remain subject to their own licence terms.

LeCodeur retains the right to showcase completed work in our own portfolio and marketing materials, including the 20+ industry demo sites hosted at demos.lecodeur.co.za, unless you request otherwise in writing.

Monthly Plan clients who cancel their subscription may request an export of their site content; continued hosting and functionality is dependent on an active subscription or a separate once-off arrangement.

7. Hosting, Uptime & Support

We take reasonable measures to ensure hosted sites remain available, but we do not guarantee 100% uptime, as this depends in part on third-party infrastructure providers.

Support response times are best-effort and prioritised by plan tier. We aim to respond to all enquiries within one business day.

We are not liable for losses arising from third-party service outages, including but not limited to domain registrars, payment gateways such as Payfast or Yoco, or hosting infrastructure providers.

8. Cancellation

Monthly Plan clients may cancel at any time by providing written notice via email or WhatsApp. Cancellation takes effect at the end of the current billing period, and no partial refunds are provided for the remainder of a billing cycle already paid.

Once-off Fee projects that are cancelled by the client after work has begun are billed pro-rata for work already completed, calculated against the total quoted fee.

9. Limitation of Liability

LeCodeur will exercise reasonable skill and care in delivering services, but we do not guarantee specific business outcomes, such as sales volumes, search engine rankings, or lead generation figures, as these depend on many factors outside our control.

To the extent permitted by law, our total liability for any claim arising from our services is limited to the total fees paid by the client for the specific project in question.

10. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes will first be addressed through good-faith direct discussion before any formal legal proceedings are considered.
